Texas Eligibility Requirements for Uncontested Divorce
Before filing, at least one spouse must have lived in Texas for six continuous months and in Galveston County for at least 90 days. These are Texas law requirements. Divorce petitions are filed with the District Clerk at the Galveston County Justice Center in downtown Galveston.
Texas is a no-fault divorce state. The most common ground is insupportability: a discord or conflict of personalities that destroys the legitimate ends of the marital relationship and prevents any reasonable expectation of reconciliation. In uncontested cases, the responding spouse typically signs a Waiver of Service acknowledging receipt of the petition rather than being formally served. From there, Texas law imposes a mandatory 60-day waiting period from the date of filing before a judge can sign the Final Decree of Divorce.
When all documents are properly completed and both parties remain in agreement, the judge may approve the final decree at a brief prove-up hearing. Most uncontested divorces in Galveston County require minimal or no court appearances when paperwork is complete. Galveston County courts may also reschedule hearings due to severe weather or emergencies such as hurricanes, which can extend timelines.
