Geographic Restrictions in a Custody Order

What does a geographic restriction in my custody order mean and how can I have it removed?

The Family Courts in the State of Texas are routinely ordering geographic restrictions on the children’s place of residence. This means that the children, and by necessity the custodial parent, must live within a certain geographic area. The geographic area is often the county in which the case is located and the counties which touch upon that county. The reason for this restriction is to help facilitate access to the children by both parents.

The restriction can be lifted in any one of the following ways:

  1. Written agreement between the parents;
  2. The non-custodial parent moves out of the geographically restricted area; or,
  3. An Order from the Court lifting or modifying the geographic restriction.
